SafeChat Terms & Conditions

1. Introduction

These Terms & Conditions ("Terms") constitute a legally binding agreement between you and SafeChat. By creating an account, uploading content, making purchases, or using SafeChat in any way, you agree to be bound by these Terms in full. If you do not agree, you may not access or use SafeChat.

2. Eligibility

Users and Creators must be at least 18 years old and must comply with all applicable local laws and regulations. By uploading or accessing adult content, you confirm that:

• You are 18 years or older.
• All individuals depicted are 18+ and have given verifiable, informed consent.

3. Payments & Fees

All payments are processed securely through Stripe. SafeChat collects a platform fee from each transaction. Creators are solely responsible for reporting and paying any taxes or legal obligations arising from their earnings.

4. Creator Payouts

Payouts are made directly to the Creator’s connected Stripe account. SafeChat is not responsible for any delay or failure in payouts due to incorrect or incomplete information provided by the Creator.

5. Content Expiry & Storage

Each Creator account includes up to 2GB per day of SafeChat-hosted storage for uploaded photos and videos.

Files are automatically deleted after 24 hours, unless marked for extended storage via the Creator’s plan.

Files priced at $0 are free to view but remain subject to the same expiration policy.

For expanded needs, Creators may connect external storage services (Google Drive, Dropbox) at their own cost. SafeChat is not liable for the availability, moderation, or security of files hosted externally.

6. NSFW & Adult Content Policy

SafeChat allows erotic, adult, or NSFW content only if:

• ✔️ It is legal in the Creator’s jurisdiction;
• ✔️ All participants are 18+ and have provided verifiable consent;
• ✔️ The content is properly tagged or marked as +18.

Prohibited content includes (but is not limited to):

• ❌ Child sexual abuse material (CSAM);
• ❌ Non-consensual or voyeuristic content;
• ❌ Revenge porn;
• ❌ Bestiality, incest, or promotion of criminal behavior.

SafeChat reserves the right to remove or restrict any content that violates these policies or applicable laws.

7. Copyright & Ownership

Creators retain full ownership of their uploaded content. However, by uploading, they grant SafeChat a limited, non-exclusive, royalty-free license to host, distribute, and make the content available within the platform according to user access permissions and pricing settings.

Creators warrant that:

• They own or are authorized to upload the content;
• They will not infringe upon third-party rights;
• They agree to indemnify and hold harmless SafeChat and its affiliates from any third-party claims, damages, or legal fees arising from their content.

8. Copyright Infringement Notice (DMCA-like Policy)

If you believe any content on SafeChat infringes your copyright, please send a detailed notice to info@safechat.space including:

• Proof of ownership;
• Link to the infringing content;
• Your contact information.

We will investigate promptly and may temporarily remove the content during review.

9. Privacy & GDPR

SafeChat respects your privacy and handles personal data in accordance with the EU GDPR and applicable privacy laws. We collect only necessary data for:

• Account creation;
• Payment processing;
• Platform functionality and security.

Legal bases for processing include contractual necessity, legal obligations, and legitimate interest. Users may request access, correction, or deletion of their data. Full details are available in our separate Privacy Policy.

10. User-Generated Content (UGC)

All files uploaded by users are considered User-Generated Content (UGC). SafeChat is a hosting platform and does not review or endorse the content unless reported.

We are not responsible for:

• Accuracy or legality of UGC;
• Damages resulting from user interaction with such content;
• Any personal or reputational harm caused by exposure to user-uploaded files.

11. Prohibited Conduct

You agree not to use SafeChat to:

• Upload or share illegal, harmful, or offensive content;
• Promote hate speech, discrimination, or harassment;
• Violate any applicable law, regulation, or third-party right.

SafeChat may suspend or delete accounts that violate these Terms without prior notice. Suspected criminal content will be reported to authorities.

12. Platform Disclaimer & Liability

SafeChat is provided "as is" and "as available", without warranties of any kind. We do not guarantee:

• Uninterrupted service;
• Error-free functionality;
• Data retention beyond expiration terms.

To the fullest extent permitted by law, SafeChat shall not be liable for indirect, incidental, punitive, or consequential damages.

13. Changes to Terms

These Terms may be updated at any time. Updates will be posted on this page and indicated by the “Last Updated” date. Continued use of SafeChat after changes signifies your acceptance.

14. Governing Law

These Terms are governed by the laws of Romania. Any disputes will be handled by the competent courts within the jurisdiction of SafeChat’s registered office.
